The Wall Street Journal: Giuliani says Trump doesn’t have to comply with Mueller subpoena

WASHINGTON—President Donald Trump could decline a possible subpoena from special counsel Robert Mueller to avoid committing perjury by testifying under oath, said Rudy Giuliani, who recently joined the president’s defense team.

“We don’t have to” comply with a possible subpoena for Trump, Giuliani said during an appearance Sunday on ABC’s “This Week.” “I’m gonna walk him into a prosecution for perjury, like Martha Stewart did?” Giuliani also left open the possibility the president could invoke his Fifth Amendment right to refuse to testify if forced to appear before a grand jury.

The president’s legal team and Mueller have been debating the conditions of a possible presidential interview as part of a continuing investigation into Russian activity during the 2016 election and whether Trump obstructed justice when he fired former FBI Director James Comey in May 2017.
